End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Bored. ("we", "us", or "our") for the use of the Bored. mobile application and web application (the "App"). By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not use the App.

This EULA supplements our Terms of Service and Privacy Policy.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial purposes, subject to this EULA and our Terms of Service.

This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

2. Restrictions

You agree not to, and you will not permit others to:

• Copy, modify, or create derivative works of the App or any part thereof.
• Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive the source code of the App.
• Make any modifications, adaptations, improvements, or translations to the App.
• Remove, alter, or obscure any proprietary notice (including copyright and trademark notices).
• Use the App for any revenue-generating, commercial, or unlawful purpose.
• Use automated systems, bots, or scripts to interact with the App.
• Sublicense, sell, resell, transfer, assign, or distribute the App.
• Use the App to send automated queries to any website or service.

3. Virtual Items

The App contains virtual items, including a virtual currency called "Boreds", badges, streaks, levels, and mascot evolutions. These virtual items:

• Have no real-world monetary value and are not redeemable for cash or any form of real currency.
• Are non-transferable between users and cannot be sold, traded, or gifted.
• Are non-refundable and may be forfeited upon account termination.
• May be modified, rebalanced, or removed by us at any time.
• Do not expire and remain in your account for as long as your account is active and in good standing.

Virtual items are a measurement of your engagement and personal growth within the App, not a financial asset.

4. User-Generated Content

The App allows you to create, post, and share content including text posts, comments, images, journal entries, and challenge submissions ("User Content"). You retain ownership of your User Content, but grant us a worldwide, royalty-free license to use, display, and distribute it solely for operating the App.

You are responsible for your User Content and must comply with our Community Guidelines. We may remove content that violates our policies.

5. Camera and Device Permissions

The App may request access to your device's camera and microphone for:

• AI Pushup Detection: Uses your camera feed with TensorFlow.js for local, on-device pose estimation. No camera data is transmitted to our servers.
• Video Rooms & Duels: Uses camera and microphone for real-time video communication via LiveKit. Streams are not recorded or stored.
• Profile Photos: Camera access for taking or uploading profile pictures.

You can revoke these permissions at any time through your device settings.

6. Updates and Modifications

We may from time to time release updates, patches, or new versions of the App. These updates may be required for you to continue using the App. We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice.

Your continued use of the App after any modifications constitutes your acceptance of the modified EULA.

7. Third-Party Services

The App integrates with third-party services including:

• Supabase: Authentication, database, file storage, and push notifications.
• LiveKit: Real-time video and audio communication.
• Apple, Google, Facebook: OAuth sign-in providers.
• TensorFlow.js: On-device AI for pose detection (runs locally).

These third-party services have their own terms and privacy policies. We are not responsible for the practices of third-party services.

8. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

We may terminate your access to the App at any time for any reason, including violation of this EULA, our Terms of Service, or our Community Guidelines.

You may terminate this EULA at any time by deleting the App from your devices and deleting your account through the App settings or by contacting contact@staybored.app.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The AI pushup detection system is provided for fitness motivation and is not a substitute for professional medical or fitness advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BORED., ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF DATA, LOSS OF VIRTUAL ITEMS, PERSONAL INJURY, OR ANY DAMAGES ARISING FROM YOUR USE OF THE APP.

Our total liability for any claims arising from or related to this EULA shall not exceed the total amount you have paid us (if any) in the twelve (12) months preceding the claim.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of Romania and the European Union, without regard to conflict of law principles. For users in the European Economic Area (EEA), nothing in this EULA affects your rights under mandatory consumer protection laws of your country of residence.

Any disputes arising under this EULA shall first be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Romania, unless mandatory consumer protection laws in your jurisdiction require otherwise.

12. Severability

If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

This EULA, together with our Terms of Service, Privacy Policy, and Community Guidelines, constitutes the entire agreement between you and Bored. regarding your use of the App and supersedes all prior agreements.
